Agreement to Terms

By accessing or using the Tethered mobile application ("App," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our Service.

Description of Service

Tethered is a mobile application designed to help families stay connected through daily photo check-ins, mood tracking, and shared journaling. The Service allows:

• Students and parents to maintain meaningful daily connections
• Daily photo check-ins with mood tracking
• Streak system to build consistent habits
• Private family-only timeline sharing
• Secure family connections via invite codes

Eligibility

You must be at least 13 years old to use Tethered. By using the Service, you represent and warrant that:

• You are at least 13 years of age
• You have the legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

If you are under 18, you must have permission from a parent or guardian to use the Service.

Account Registration

Account Creation:

• You must provide accurate and complete information when creating an account
• You must maintain the security of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access

Account Types:

• Student Account: For daily check-ins and streak maintenance
• Parent Account: For viewing and supporting student's journey

One Account Per Person:
Each user may only create one account. Creating multiple accounts may result in suspension.

User Conduct

Acceptable Use

You agree to use Tethered only for its intended purpose: staying connected with family members through daily check-ins.

Prohibited Activities

You agree NOT to:

Content Violations:

• Upload, post, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Share sexually explicit, violent, or graphic content
• Upload content that infringes on intellectual property rights of others
• Impersonate any person or entity

Technical Violations:

• Attempt to gain unauthorized access to the Service or systems
• Use automated scripts, bots, or scrapers
• Reverse engineer, decompile, or disassemble the App
• Introduce viruses, malware, or harmful code
• Interfere with or disrupt the Service

Misuse:

• Use the Service for commercial purposes without authorization
• Sell, transfer, or sublicense your account
• Spam or harass other users
• Share invite codes publicly or with strangers

User Content

Your Content

You retain all rights to the content you create and share through Tethered, including:

• Photos you upload
• Journal entries and reflections
• Mood selections

License to Us

By posting content, you grant Tethered a worldwide, non-exclusive, royalty-free license to:

• Store and display your content within the Service
• Enable sharing with your connected family members
• Create backups and ensure service functionality

This license terminates when you delete your content or account.

Content Responsibility

• You are solely responsible for the content you share
• We do not endorse, support, or guarantee the accuracy of user content
• We reserve the right to remove content that violates these Terms

Family Connections

Invite Codes:

• Each student account can generate a unique family invite code
• Only share invite codes with trusted family members
• Invite codes allow access to your check-ins, photos, and streak data

Connected Family Members:

• Can view your timeline, photos, and streak data
• Cannot edit or delete your content
• You can remove family connections at any time

Your Responsibility:
You are responsible for who you connect with. Only share invite codes with people you trust.

Streak System

How Streaks Work:

• Check-ins must occur at least once every 24 hours to maintain a streak
• Streaks reset if no check-in occurs within 24 hours
• Streak data is shared with connected family members
• We do not guarantee streak accuracy and are not liable for streak losses due to technical issues

Subscriptions and Payments

Premium Features:

• Tethered offers optional premium subscriptions with enhanced features
• Subscription tiers: Monthly ($4.99), Annual ($29.99), Lifetime ($44.99)
• Prices are subject to change with notice

Billing:

• Subscriptions are billed through your Apple App Store account
• Auto-renewal occurs unless canceled at least 24 hours before the period ends
• You can manage subscriptions in your App Store settings

Refunds:

• Refunds are handled through the Apple App Store
• Contact Apple Support for refund requests
• We do not directly process refunds

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand:

• What data we collect
• How we use your data
• How we protect your information
• Your rights regarding your data

Intellectual Property

Our Rights:
The Tethered app, including all content, features, functionality, design, logos, and trademarks, is owned by Tethered and is protected by copyright, trademark, and other intellectual property laws.

Your License:
We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App on your personal device
• Access and use the Service for personal, non-commercial purposes

You may NOT:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or distribute the App
• Remove any copyright or proprietary notices

Push Notifications

Notification Types:

• Daily reminder notifications
• Streak warning notifications
• Family activity notifications

Your Control:
You can disable push notifications at any time through your device settings.

Account Deletion

Your Right:
You may permanently delete your account at any time from the Settings screen within the App.

What Gets Deleted:

• Your profile and account information
• All check-in photos and journal entries
• Streak data
• Family connections
• All associated personal data

Deletion Process:
Data is permanently and immediately removed from our systems upon account deletion. This action cannot be undone.

Service Availability

No Guarantee:
We strive to provide reliable service but do not guarantee:

• Uninterrupted or error-free access
• Service will meet all your requirements
• All bugs will be corrected

Maintenance:
We may temporarily suspend the Service for maintenance, updates, or repairs with or without notice.

Right to Modify:
We reserve the right to modify, suspend, or discontinue the Service at any time.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TETHERED SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or errors
• Loss of streaks due to technical issues
• Unauthorized access to your data

TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Tethered, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another person
• Your use of the Service
• Content you post or share

Termination

By You:
You may terminate your account at any time by deleting your account through the App.

By Us:
We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account poses a security risk
• Required by law

Effect of Termination:
Upon termination:

• Your right to use the Service ceases immediately
• Your data will be deleted according to our Privacy Policy
• Provisions that should survive termination will remain in effect

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Posting updated Terms in the App
• Updating the "Last Updated" date
• Sending a push notification for material changes

Your Continued Use:
Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict of law provisions.

Dispute Resolution

Informal Resolution:
Before filing a claim, you agree to contact us at support@tethered.app to attempt to resolve the dispute informally.

Arbitration:
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver:
You agree to resolve disputes on an individual basis and waive the right to participate in class actions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tethered regarding the Service and supersede all prior agreements.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
